We specialise in group personal training, personal training, and sports nutrition, offering guidance on fitness and healthy lifestyle. Our services are designed not just to exercise the body but to promote general fitness and wellbeing, all within a supportive, community-driven environment. 

While we're passionate about empowering our members to reach their peak physical condition, it's essential to note that we do not diagnose or treat diseases. 

Our mission is simple: to operate for the benefit of our members, our staff, and our company owners, creating an inclusive space where everyone, regardless of their fitness level, feels part of the Fit Tribe family.

Acceptance of Terms

By joining Fit Tribe NI Ltd.,members affirm their commitment to their health and well-being, joining a community that values strength, growth, and mutual support. 

Our services and programs are available to individuals who are 18 years of age and older. However, we extend our welcoming arms to younger participants for equivalent services, provided they have the consent of a parent or legal guardian. 

Acknowledgment and acceptance of our Terms of Service are required from all who wish to engage in any activity facilitated by Fit Tribe NI Ltd., ensuring a shared understanding and respect for the guidelines that help our community thrive. 

Upon signing up for membership through our website, members are required to sign an electronic waiver, a testament to our mutual commitment to safety, respect, and the pursuit of fitness excellence.

Modification of Terms

Fit Tribe NI Ltd. reserves the right to update or modify these Terms of Service at any time to reflect changes in our services, legal obligations, or the way we operate our business. 

We are committed to transparency and will notify our members of any significant changes through direct communication methods such as email and notices on our website. 

By continuing to use our services after the communication of such changes, members and participants agree to be bound by the updated Terms of Service. 

We encourage all members to review any modifications to stay informed about their rights and obligations within the Fit Tribe community.

Membership and Access

At Fit Tribe NI Ltd., our membership tiers are designed to cater to a variety of fitness needs and preferences, embodying our commitment to providing a flexible and supportive fitness environment. 

We offer a range of membership options, each including specific features and benefits to enhance your fitness journey. Details of our current membership tiers and their respective benefits are available on our website, fittribe.co.uk, and are subject to periodic updates in line with our evolving business strategy.

Upon signing up for our services, we collect essential personal information, including your name, address, & contact details, as well as an emergency contact for safety. 

We also invite new members to complete a lifestyle questionnaire and outline their fitness goals, allowing us to tailor our services more effectively to each individual's needs. 

A vital part of our onboarding process is the completion of a Physical Activity Readiness Questionnaire (PAR-Q). This form helps us understand any medical conditions, medications, surgeries, or hospitalisations you may have had, ensuring your training is both safe and effective. In certain cases, medical clearance from a doctor may be required.

Access to our facilities is granted under the guidance of our knowledgeable staff. Members will receive instruction on the proper use of equipment; however, it's important to note that Fit Tribe NI Ltd. cannot accept responsibility for injuries resulting from improper use. 

Non-members may enjoy access to our facilities and services under specific conditions, such as by invitation and always in the presence of a staff member, ensuring a controlled and welcoming environment for all.

Payment, Fees, and Cancellation

Our commitment to flexibility and convenience extends to our payment options, and we accept payment by direct debit and credit or debit card payments. Direct Debit payments are processed by industry leaders GoCardless (https://gocardless.com/) who use strong encryption and other digital security technology to keep your information safe.  Card payments are processed by industry leaders Stripe (https://stripe.com/gb/) to process payments in accordance with the highest available standards of data protection and fraud prevention.  

Memberships are billed on a monthly basis by default, but we also offer a variety of services available for one-off payments, all of which are detailed on our website and mobile app.

We understand that your fitness journey may change direction, which is why members can effortlessly upgrade, downgrade, or cancel their memberships at any time through their account on our website or mobile app. For monthly memberships, any cancellation will take effect at the end of your current billing period, ensuring you have full access until then. Please note, we do not offer refunds for any unused portions of a month.

This approach ensures our members enjoy the utmost flexibility, allowing them to adapt their fitness journey to their current needs and circumstances without unnecessary constraints.

Health and Safety

At Fit Tribe NI Ltd., your health and safety are of paramount importance. As part of our commitment to ensuring a safe and productive training environment, we require all members and participants to adhere to our health and safety guidelines. This includes the completion of a Physical Activity Readiness Questionnaire (PAR-Q) to identify any health concerns that could affect your ability to safely participate in physical activity. Additionally, we require members to inform us of any past or present medical conditions, medications, surgeries, or hospitalisations.

In certain cases, a doctor's medical clearance may be necessary to participate in our programs.

We also emphasise the importance of proper use of all equipment and facilities. Instruction on the correct use of equipment will be provided by an authorised member of staff, and members must adhere to these guidelines. While we strive to maintain a safe training environment, members are ultimately responsible for the correct use of equipment. Unauthorised or improper use of equipment is strictly prohibited and may result in termination of membership.

Use of Facilities and Equipment

Fit Tribe NI Ltd. offers a wide range of facilities and equipment designed to cater to various fitness levels and preferences. To ensure a positive and safe experience for all members, the following guidelines must be observed:

• Access to our facilities is permitted only when an authorised member of staff is present.

• All members must receive instruction on the proper use of equipment before use.

• Members are responsible for using all equipment and facilities in a safe and respectful manner, in accordance with staff instructions.

• Equipment must be used only for its intended purpose and must be returned to its proper place after use.

• Non-members are welcome to use the facilities under certain conditions, including invitation by Fit Tribe NI Ltd. and in the presence of a member of staff. This policy ensures that all users of our facilities enjoy a safe, productive, and welcoming environment.

Conduct and Behavior

The spirit of community at Fit Tribe NI Ltd. is built on mutual respect, encouragement, and the shared pursuit of health and fitness goals. We expect all members and guests to contribute positively to this environment by adhering to the following conduct guidelines:

• Treat all members, guests, and staff with respect and courtesy.
• Maintain a positive and supportive atmosphere, free from harassment or disruptive behaviour.
• Respect the privacy and personal space of others.
• Follow all health and safety instructions provided by staff members.

Violation of these conduct guidelines may result in disciplinary action, up to and including termination of membership, to maintain the integrity of our community.  In the event that your membership is terminated under this policy, no refunds will be given.

Limitation of Liability

At Fit Tribe NI Ltd., we are dedicated to providing a safe, supportive, and effective training environment for all our members and participants. However, it's important to recognise that physical exercise, by its nature, carries inherent risks. By agreeing to participate in any physical activities, use of equipment, or any other services provided by Fit Tribe NI Ltd., members and participants acknowledge and accept these risks.

Personal Injury and Damages

Members and participants agree that Fit Tribe NI Ltd., including its owners, employees, and affiliates, will not be liable for any personal injury, damage, or loss to any individual or personal property that may occur on the premises or during participation in any Fit Tribe NI Ltd. activities. 

This includes, but is not limited to, injuries resulting from equipment malfunction, other members' actions, or one's own negligence.

Acknowledgment of Risk 

By participating in activities and using facilities and equipment provided by Fit Tribe NI Ltd., members and participants acknowledge the risks involved in physical exercise and accept full responsibility for any injuries or damages that may occur.

Indemnification

Members and participants agree to indemnify and hold harmless Fit Tribe NI Ltd. and its representatives from any claims, demands, or lawsuits, including legal fees, arising out of their participation in activities or use of the facilities.

Health and Safety Compliance

It is the responsibility of all members and participants to comply with health and safety instructions provided by Fit Tribe NI Ltd. staff. Failure to comply with these guidelines may increase the risk of injury or harm.

Severability

Should any provision of this Limitation of Liability be found to be legally unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, maintaining the document's integrity as much as legally possible.

This agreement is an acknowledgment of the voluntary acceptance of risk by members and participants and a commitment to follow all guidelines and instructions provided by Fit Tribe NI Ltd. for personal safety and the safety of others.

Privacy Policy

Personal Data Collection and Use

Fit Tribe NI Ltd. is committed to protecting the privacy and security of our members and participants. The personal data we collect includes name, address, contact information, emergency contact details, lifestyle questionnaire responses, and fitness goals. This information is vital for tailoring our services to meet your needs, ensuring safety during workouts, and facilitating effective communication. Personal data may also be used for membership management, service improvements, and, with your consent, marketing communications.

Security Measures

We implement robust security measures to protect your personal information against unauthorised access, alteration, disclosure, or destruction. These include secure data storage practices, encrypted communication, and restricted access to personal information by authorised staff only.

Intellectual Property

Content Ownership

All content provided by Fit Tribe NI Ltd., including text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Fit Tribe NI Ltd. or its suppliers and protected by copyright and other laws. The Fit Tribe name and logo, and all related product and service names, design marks, content and slogans are the trademarks or service marks of Fit Tribe NI Ltd. 

Unauthorised use of our intellectual property may result in legal action.

Dispute Resolution

Resolving Disputes

Fit Tribe NI Ltd. aims to resolve any disputes amicably and efficiently. Should a dispute arise, members are encouraged to contact a member of our team first to seek a resolution. If a dispute cannot be resolved internally, we prefer mediation or arbitration as methods to settle disputes. This approach is designed to ensure that any issues are resolved in a manner that is both fair and cost-effective for all parties involved.

In the event of any dispute or difference arising between the parties, either party may refer the matter to the Law Society of Northern Ireland Dispute Resolution Service (‘the service), and if the dispute is not resolved within 14 days of referral to the service (or such longer period as both parties agree) then mediation will be deemed to be at an end.  

Any matter which requires mediation to be decided by arbitration is to be referred to a single arbitrator under the Arbitration Act (1996).  Either party may agree to the appointment of an arbitrator, or either may apply to the President of the Law Society of Northern Ireland to make the appointment.

Termination of Services

Termination Conditions:  Fit Tribe NI Ltd. reserves the right to terminate a membership or deny access to services under certain conditions, including but not limited to non-compliance with our health and safety guidelines, breach of our terms of service, or any behaviour that significantly disrupts the community environment. 

Members may terminate their membership at any time through their account settings, with termination effective at the end of the current billing period.

Miscellaneous

Governing Law

These terms and any dispute arising from the use of our services will be governed by and construed in accordance with the laws of Northern Ireland, without giving effect to any choice or conflict of law provision or rule.

Affiliation

Fit Tribe NI Ltd. operates independently and is not affiliated with any other entities unless explicitly stated.
